Under current legislation, foreign nationals who are married to a Maltese citizen may acquire Maltese citizenship by registration after completing five years of marriage.
Applicants must remain married to a Maltese citizen at the time of application and must have been married and living together for at least five years.
While the law requires the couple to be living together, it does not require them to reside together in Malta.

- Widows and widowers may apply if they were married to and living with a Maltese citizen for at least five years before their spouse's death.
- Applicants must submit a joint affidavit confirming the marriage has lasted at least five years and that the couple is living together.
- Applicants must provide a marriage certificate registered in Malta.
